NOTO Confirms Personal Groceries Will Be Exempt From Tariffs

Good news! US guests will not be charged the tariffs on grocery items.

NOTO has received confirmation from the Director General of CBSA through TIAC and a CBSA Superintendent at the Fort Frances border that tariffs will NOT be applied to personal items including consumable items brought into Canada by non-resident visitors. These grocery items will need to be in an amount that is “appropriate for their needs and consistent with the purpose, nature and duration of their intended stay in Canada.”

Food limits will continue to apply as always for dairy and meat products as set out by the Canadian Food Inspection Agency (CFIA). Personal limits for the following items still apply:
(a) 1.5 L of wine, or 1.14 L of spirits, or 1.14 L of wine and spirits, or 8.5 L of beer or ale;
(b) 200 ci******es, 50 ci**rs, 200 g of manufactured to***co and 200 to***co sticks; or
(c) 200 rounds of ammunition or, if they are for the use of that person at a meet held under the auspices of a recognized shooting or rifle association of Canada, 1,500 rounds of ammunition.

If guests are bringing in items that will remain in Canada, those items will be subject to tariffs based on where they are manufactured.

Tariffs and Personal Imports

We received reports that US visitors are being charged tariffs on food products that they are bringing across the border that are for personal use during their stay. NOTO reached out to CBSA for clarification and received the following confirmation:

"As of now (and please keep in mind this is a very fluid situation and things can change), the tariffs will be charged on applicable personal goods that are not included in a personal exemption.

Non-resident visitors to Canada have an exemption for their personal baggage (ie clothes, suitcases, fishing rods, tackle, etc) for goods suitable for the purpose and duration of their trip. They also have their 1.14L/1 case of beer exemption and 1 carton/50 ci**rs exemptions.

There is no exemption for consumable items such as groceries. Traditionally these have not been an issue as many categories of groceries are non-taxable food items.

A significant number of food items are included in the list of goods currently subject to the 25% tariffs including poultry, eggs, dairy, vegetables, fruit, coffee, tea, pasta and many more. Unless there is a change in posture, the list will be expanding as this only covers approximately $30 billion of the $155 billion in proposed retaliatory tariffs that Canada will be implementing in response to US tariffs.

For returning residents, personal exemptions ($200 after 24hr absence, $800 after 48hr absence) are exempt from the tariffs. Any goods outside of an exemption are not.

It should also be noted that the importer is responsible for paying HST on top of the 25% tariff. For a resident, that amounts to 13% (for a total of 37%) and for a non-resident (entering Canada in Ontario) it is 5% for a total of 30%."

NOTO has written to Dominic LeBlanc, Minister of Finance, to request an exemption for US guests that have trips booked with tourism businesses. In the meantime, it is our recommendation that you prepare your guests by sharing this information and encouraging them to purchase their grocery items in Canada. Considering the exchange rate, it could provide substantial savings for them as well as reduce any negative experiences at the border.
